TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
By accessing or using FindMeComics ("the Site," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.
We reserve the right to update these Terms. Except where changes are legally required or urgently necessary to address fraud or security risks, we will give at least 30 days' advance notice of material changes — via email to your registered address or a prominent notice on the Site — before they take effect. Continued use after the notice period constitutes acceptance. If you do not accept updated Terms, you may close your account before they take effect.
2. THE PLATFORM — WE ARE A MARKETPLACE
FindMeComics is a peer-to-peer marketplace that connects individual buyers and sellers of comic books. We are not a seller. We do not own, inspect, grade, or ship any items listed on the Site. All transactions are directly between buyers and sellers. FindMeComics is not a party to any transaction and makes no representations or warranties regarding the items listed.
PAYMENT FACILITATION AND MERCHANT OF RECORD
FindMeComics processes payments on behalf of sellers as a limited payment agent using Stripe. The descriptor on your payment statement will reference FindMeComics or Stripe. Proceeds — minus the platform fee — are transferred to the seller's Stripe Connect account.
The legal contract of sale is between the buyer and the seller. FindMeComics is not a party to that contract. Each seller is the merchant for their own items and remains solely responsible for fulfilling the order, accurately describing the item, and complying with all applicable consumer protection and tax laws. EU-resident sellers acting in a commercial capacity must additionally comply with EU consumer rights obligations (Directive 2011/83/EU) when selling to EU consumers. FindMeComics administers the dispute and refund process as a facilitation service only — see our Refund Policy.
3. ACCOUNTS
You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account and all activity under it. You agree to provide accurate information and to keep it current. We reserve the right to suspend or terminate accounts that violate these Terms, and to suspend or terminate any account where we have reason to believe the user is under 18 — regardless of any prior age confirmation. Before completing a purchase of $50 or more you may be asked to re-affirm that you are 18 or older; this re-confirmation is recorded as part of your consent log.
ELIGIBILITY — SANCTIONS AND EXPORT CONTROLS
FindMeComics is operated from the United States and complies with U.S. economic sanctions and export control laws, including regulations administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC). By creating an account or otherwise using the Site, you represent and warrant that:
- You are not located in, incorporated in, or ordinarily resident in a country or territory subject to a U.S. government comprehensive trade embargo — currently Cuba, Iran, North Korea (Democratic People's Republic of Korea), and Syria (31 C.F.R. Parts 515, 560, 510, and 542, respectively).
- You are not identified on any U.S. government restricted-party list, including the OFAC Specially Designated Nationals and Blocked Persons (SDN) List, the OFAC Consolidated Sanctions List, or the U.S. Commerce Department Denied Persons List.
- You will not use the Site to facilitate any transaction on behalf of, or for the benefit of, any person or entity subject to U.S. sanctions, or to transfer value to any sanctioned country, territory, or person.
- You will not use a VPN, proxy, anonymizing network (including Tor), or any other means to circumvent the IP-based country screen applied at registration or at any other point. Circumventing this screen constitutes a knowing material misrepresentation under this section and is immediate grounds for account termination.
We perform a good-faith country-level IP screen at registration as a technical compliance measure. This screen does not constitute a complete OFAC compliance program; Stripe also performs independent payment-layer sanctions screening. You remain solely responsible for ensuring your use of the Site complies with all applicable U.S. and international trade regulations. Accounts found to violate this section will be immediately suspended and any pending payouts may be frozen pending legal review.
4. SELLER RESPONSIBILITIES
By listing an item, you represent and warrant that:
- You are the legal owner of the item and have the right to sell it.
- All item descriptions, conditions, and photographs are accurate and complete.
- You will ship the item promptly upon confirmed payment.
- You will provide a valid tracking number for every shipment. Marking an order as shipped without a tracking number is not permitted.
- You will not list counterfeit, stolen, or otherwise illegal items.
SALES TAX
FindMeComics operates as a marketplace facilitator under applicable US state laws. Where legally required, FindMeComics collects sales tax from buyers at checkout and remits it directly to the relevant state tax authority on your behalf. You do not receive or handle this tax, and it is never included in your payout.
You remain solely responsible for: (a) federal and state income tax on your net earnings; (b) self-employment tax; (c) 1099-K reporting obligations triggered by Stripe; and (d) any taxes not covered by marketplace facilitator laws in a given jurisdiction. See our Tax Policy for a full explanation and state-by-state threshold table. FindMeComics does not provide tax advice — consult a qualified CPA for guidance specific to your situation.
Sellers who misrepresent items, fail to ship, or repeatedly receive disputes may be suspended or permanently banned.
5. BUYER RESPONSIBILITIES
By purchasing an item, you agree to complete payment promptly and to communicate in good faith with the seller. Frivolous disputes or chargebacks may result in account suspension.
If a seller does not mark your order as shipped within 7 calendar days of payment, FindMeComics will automatically issue you a full refund — no action required. For pre-shipment cancellations, post-shipment disputes, and refund timing, see our Refund Policy. FindMeComics is a marketplace facilitator and does not fund dispute payouts from its own balance; all refunded amounts are recovered from the seller.
6. FEES
FindMeComics charges sellers a 9% platform fee on completed sales only — listing is always free. There are no buyer fees. Orders under $6 pay a $1 minimum fee to cover payment processing costs. We reserve the right to adjust fees in the future with at least 30 days' notice to users. Seller badges and standing criteria are disclosed at /seller-tiers.
7. PROHIBITED CONTENT AND CONDUCT
The following are your obligations as a condition of using the Site. These rules govern what you may post — they are not a representation by FindMeComics that it will detect or prevent such content before it appears, and they do not create any duty on our part to pre-screen user content. See Section 8.
You agree not to post, upload, or transmit any content that:
- Is illegal, obscene, defamatory, threatening, or harassing.
- Infringes any copyright, trademark, or other intellectual property right.
- Contains child sexual abuse material (CSAM). We are legally required to report such content to the National Center for Missing & Exploited Children (NCMEC) and cooperate fully with law enforcement.
- Constitutes spam, phishing, or fraudulent activity.
- Violates any applicable local, state, national, or international law.
We reserve the right to remove any content and terminate any account at our sole discretion, without liability and without any obligation to monitor for violations.
8. USER-GENERATED CONTENT AND SECTION 230
All listings, photographs, descriptions, messages, and other content on FindMeComics are created and published entirely by users. FindMeComics is a passive conduit for that content.
NO PRE-SCREENING
FindMeComics does not review, verify, or pre-screen listings, photographs, or other user content before it appears on the Site. The content prohibitions in Sections 4 and 7 are covenants you make to us as a condition of using the Site — they are not a promise by FindMeComics that prohibited content will never appear, and they do not create any duty on FindMeComics to monitor for, detect, or prevent prohibited content before publication. You are solely responsible for the content you post.
SECTION 230 PROTECTION
FindMeComics is an interactive computer service protected by Section 230 of the Communications Decency Act, 47 U.S.C. § 230(c)(1), which provides that "[n]o provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider." FindMeComics is therefore not civilly liable for listings, descriptions, photographs, messages, or other content created or published by users, even if that content is unlawful, inaccurate, defamatory, counterfeit, or otherwise harmful. This protection applies regardless of whether FindMeComics was notified of the content.
HOW WE HANDLE REPORTED CONTENT
We remove or disable access to content reactively — upon receipt of:
- A valid DMCA § 512(c)(3) takedown notice (see Section 14 and our DMCA Policy);
- A credible report submitted through our report function or to legal@findmecomics.com; or
- A court order or other lawful legal process.
Voluntary removal of content does not waive our § 230 protection, does not constitute an admission that the content was unlawful, and does not create any ongoing duty to monitor, review, or remove similar content.
CONTENT LICENSE
By submitting content to FindMeComics (including listing photos, descriptions, database edits, reading-order guides, reviews, and messages), you grant FindMeComics and its successors a non-exclusive, worldwide, royalty-free, sublicensable license to reproduce, modify, adapt, create derivative works of, publish, translate, display, distribute, and use that content — including for promotional and marketing purposes — solely in connection with operating, improving, and promoting the Site and its services. Sublicensing is limited to infrastructure and service partners necessary to deliver the Site, including CDN and hosting providers, search-indexing services, and AI-assisted cover identification services (e.g. visual search that matches a listing photo to a known comic edition); we do not sell your content to third parties.
Survival: This license survives termination of your account with respect to: (a) content that has been incorporated into completed transaction records (including sold-listing photos retained as part of the transaction record), dispute files, or legal compliance records, which we are required or permitted by law to retain; and (b) aggregated or anonymised data that does not identify you. You may request deletion of other content consistent with our Privacy Policy.
You represent that you own or have the necessary rights to grant this license and that your content does not infringe any third-party copyright, trademark, privacy, or other intellectual property rights.
9. BUYER PROTECTION
The Buyer Protection program described at /buyer-protection sets out the dispute-resolution services FindMeComics provides for transactions on the Site, the timeframes for claims, and the categories of disputes covered. FindMeComics's obligations under the program are limited to the procedures described there and to refund amounts actually recoverable from the seller's Stripe Connect account. Nothing in the program creates a guarantee of payment beyond what is recoverable from the seller, and nothing in the program limits any right you may have under applicable law that cannot be waived by agreement (including the Fair Credit Billing Act, 15 U.S.C. § 1666).
10. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDMECOMICS AND ITS OPERATORS EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT (UCC § 2-316(2)). THE SITE, ITS CONTENT, AND ALL ITEMS LISTED BY THIRD-PARTY SELLERS ARE PROVIDED "AS IS" AND "AS AVAILABLE." FINDMECOMICS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, CONDITION, COMPLETENESS, OR SUITABILITY OF ANY LISTING OR ITEM.
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDMECOMICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY TRANSACTION CONDUCTED THROUGH IT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE FEES PAID BY YOU TO FINDMECOMICS IN THE THREE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Nothing in this section excludes or limits FindMeComics' liability for: (a) death or personal injury caused by FindMeComics' negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or willful misconduct; or (d) any liability that cannot lawfully be excluded or limited under applicable consumer-protection law, including the California Consumer Legal Remedies Act (Cal. Civ. Code §§ 1750 et seq.) and any equivalent state statute.
12. INDEMNIFICATION
Your indemnification of FindMeComics. You agree to defend, indemnify, and hold harmless FindMeComics and its operators from and against any third-party claims, losses, damages, and reasonable legal fees arising from: (a) your use of the Site in violation of these Terms; (b) items you list, sell, or purchase; (c) your material violation of any applicable law; or (d) your infringement of a third party's intellectual property rights. This obligation does not apply to the extent the claim results from FindMeComics' own negligence, fraud, or breach of these Terms (see CA Civ. Code § 2782).
FindMeComics' indemnification of you. FindMeComics agrees to defend, indemnify, and hold harmless you from and against any third-party claims, losses, damages, and reasonable legal fees arising solely from FindMeComics' gross negligence or willful misconduct in the operation of the platform, except to the extent caused by your own actions.
Procedure. The party seeking indemnification must: (a) notify the other party in writing within 30 days of learning of the claim; (b) grant the indemnifying party sole control of the defense, subject to reasonable consent on any settlement that imposes obligations or admissions on the indemnified party; and (c) provide reasonable cooperation at the indemnifying party's expense. Failure to give timely notice does not waive indemnification rights except to the extent the indemnifying party is materially prejudiced by the delay.
13. COVER IMAGES & INTELLECTUAL PROPERTY
Comic book cover images displayed on FindMeComics outside of marketplace listings are low-resolution thumbnails used solely for identification and navigation purposes — equivalent to a library catalog card or search-engine thumbnail. They are sourced from community databases (Comic Vine, AniList, Grand Comics Database) and are displayed solely to help users identify and locate specific comics. FindMeComics does not reproduce these images for commercial gain, does not claim any rights to publisher cover artwork, and does not use cover thumbnails as the basis of any commercial transaction.
Marketplace listings display only photographs uploaded by the seller of the specific physical item being offered for sale. FindMeComics does not host, display, or reproduce publisher-owned cover art in the context of any commercial transaction.
If you are a rights holder and believe an image on this site is being used in a manner that exceeds permissible use, please submit a notice via our DMCA page or email legal@findmecomics.com. We will respond within 48 hours.
14. DMCA / COPYRIGHT
We respect intellectual property rights and comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512. If you believe content on FindMeComics infringes your copyright, please visit our DMCA Policy page to submit a formal takedown notice or email legal@findmecomics.com. Valid notices must include all elements required by § 512(c)(3): identification of the copyrighted work; location of the infringing material; your contact information; an ownership statement; a good faith statement; and a statement of accuracy under penalty of perjury. We will process valid notices within 48 hours.
Counter-notices may be submitted to legal@findmecomics.com under § 512(g). FindMeComics will terminate the accounts of repeat infringers in appropriate circumstances, consistent with § 512(i)(1)(A). See our DMCA page for the full policy and counter-notice process.
15. BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.
STEP 1 — INFORMAL RESOLUTION (REQUIRED BEFORE ARBITRATION)
Before initiating any arbitration or court proceeding, you agree to give FindMeComics a genuine opportunity to resolve your concern. Send a written notice to legal@findmecomics.com describing your claim in reasonable detail and the relief you seek. We will respond within 30 days. If the dispute is not resolved within 30 days of your notice, either party may proceed to arbitration as described below. This informal resolution step is a condition precedent to arbitration; an arbitrator may dismiss a demand filed without completing it.
STEP 2 — BINDING INDIVIDUAL ARBITRATION
Except for the claims listed under Exceptions below, you and FindMeComics agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Refund Policy, or your use of the Site — including questions about the existence, validity, interpretation, or enforceability of this arbitration agreement — will be resolved exclusively by binding individual arbitration, not in a court of law.
The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs this agreement to arbitrate and its interpretation and enforcement. This arbitration agreement is mutual — it binds both you and FindMeComics equally.
ARBITRATION RULES AND PROCEDURE
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the arbitration is filed, as modified by these Terms, and conducted before a single neutral arbitrator. To initiate, visit adr.org or call 1-800-778-7879.
Proceedings will be conducted by phone, video conference, or written submissions unless either party requests an in-person hearing and the arbitrator determines one is warranted. Any required in-person hearing will take place in the county of your primary residence (or another mutually agreed location).
FEES
For claims of $10,000 or less, FindMeComics will pay all AAA filing, administration, and arbitrator fees unless the arbitrator determines that your claim was frivolous or brought for an improper purpose. For claims over $10,000, AAA's standard fee-allocation rules apply. Each party is responsible for its own attorneys' fees unless applicable law or the arbitral award provides otherwise.
CLASS ACTION WAIVER
YOU AND FINDMECOMICS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.
California users: Nothing in this class action waiver prevents you from seeking public injunctive relief in a court of law to the extent that such relief is available under applicable law and cannot be waived by pre-dispute agreement (see McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017)). Any such claim for public injunctive relief shall be severed from arbitration and litigated in a court of competent jurisdiction; all other claims remain subject to this arbitration agreement.
If the class action waiver in this section is found unenforceable as to a particular claim, then the arbitration agreement shall not apply to that claim and it shall proceed in court. This severability provision does not affect any other part of this section.
BATCHED ARBITRATION (MASS FILINGS)
If 25 or more individuals represented by the same counsel, or coordinating with one another, file arbitration demands raising substantially similar claims against FindMeComics within any 30-day period (a "Mass Filing"), the following modified procedure applies:
- AAA will group the demands into batches of up to 50 demands. Each batch will be treated as a single consolidated arbitral proceeding before one arbitrator, with one set of filing and administrative fees.
- Within each batch, the arbitrator will designate up to 10 "bellwether" demands to be heard and decided first on a schedule agreed with the parties. All remaining demands in that batch are stayed pending the bellwether outcomes.
- FindMeComics' obligation to pay AAA fees is limited to fees attributable to one batch at a time; fees for the next batch become payable only as each prior batch concludes.
- Nothing here limits any individual claimant's substantive rights or available relief. The batching procedure is an administrative mechanism only.
If AAA declines to administer under this procedure, either party may petition a court of competent jurisdiction for an order consistent with this section before proceeding.
EXCEPTIONS — NOT SUBJECT TO ARBITRATION
The following claims are excluded from this arbitration agreement and may be brought in court:
- Small claims: Claims within the jurisdiction of a small claims court (so long as they remain in small claims court and do not seek class or representative relief).
- Intellectual property and injunctive relief: Claims seeking emergency injunctive or other equitable relief to prevent imminent, irreparable harm related to intellectual property rights, trade secrets, or platform security, pending resolution of the underlying dispute in arbitration.
- DMCA / copyright: Claims arising under the Digital Millennium Copyright Act filed with a court or processed under our DMCA Policy.
OPT-OUT
You may opt out of this arbitration agreement within 30 days of (a) first creating a FindMeComics account, or (b) May 1, 2026 (the date this clause was last materially updated), whichever is later — by emailing legal@findmecomics.com with the subject line “Arbitration Opt-Out” and your account email address. You may also opt out by mailing a written notice to the same contact address. Opting out does not affect your ability to use the Site or any other provision of these Terms. If you do not opt out, you waive your right to litigate disputes covered by this section in court.
This arbitration agreement survives account closure and termination of these Terms.
16. DATA BREACH AND ACCOUNT SECURITY
SECURITY MEASURES
FindMeComics implements industry-standard technical and organisational security measures, including bcrypt password hashing, HTTPS with HSTS, network-level database access controls, Content Security Policy headers, and PCI DSS SAQ A card-data isolation through Stripe (we never receive, process, or store raw card numbers). A full description of our security controls is in our Privacy Policy § 11.
OUR BREACH NOTIFICATION COMMITMENT
If we confirm a data breach likely to affect your personal information, FindMeComics will:
- Notify you by email within 30 days of confirmation — describing what happened, which categories of data were involved, steps we are taking, and what you can do to protect yourself.
- Notify applicable regulators as required by law: EU supervisory authorities within 72 hours (GDPR Art. 33), California Attorney General where required (Cal. Civ. Code § 1798.82), and other state authorities as applicable under all 50 states' breach notification laws.
- Take immediate containment steps — isolating affected systems, revoking compromised credentials, patching the root cause, and preserving logs for forensic review.
Full notification procedures, the definition of “confirmed breach,” and breach notice contents are set out in our Privacy Policy § 11, which is incorporated into these Terms by reference.
YOUR ACCOUNT SECURITY OBLIGATIONS
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately at legal@findmecomics.com if you suspect unauthorised access to your account or credentials. FindMeComics is not liable for losses arising from your failure to keep your credentials confidential or your failure to report suspected compromise promptly.
LIABILITY FOR SECURITY INCIDENTS
To the maximum extent permitted by applicable law, FindMeComics' liability arising from any data breach or security incident is governed by Section 11 (Limitation of Liability). We are not liable for breaches caused by your own actions (e.g., password reuse, responding to phishing) or attributable to third-party services acting as independent data controllers (e.g., Stripe for payment card data).
RESPONSIBLE DISCLOSURE
If you discover a security vulnerability in the Site, please report it responsibly to legal@findmecomics.com. We will acknowledge your report within 24 hours and work to remediate confirmed issues promptly. We will not take legal action against good-faith security researchers who follow responsible disclosure practices.
17. GOVERNING LAW AND FORUM SELECTION
CHOICE OF LAW
The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of the arbitration agreement in Section 15. All other matters arising from or relating to these Terms, the Privacy Policy, or your use of the Site are governed exclusively by the laws of the State of Delaware and applicable federal law, without regard to conflict-of-law rules or the UN Convention on Contracts for the International Sale of Goods.
FORUM SELECTION
For any claim excluded from arbitration under Section 15 — or if Section 15 is found invalid or inapplicable — you and FindMeComics each irrevocably consent to the exclusive personal jurisdiction and venue of the federal and state courts sitting in the State of Delaware. You waive any objection to the laying of venue in those courts, and any claim that such courts are an inconvenient forum.
Nothing in this section limits FindMeComics' right to seek emergency injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information pending resolution of a dispute.
NON-WAIVABLE CONSUMER RIGHTS
Notwithstanding the choice-of-law and forum-selection provisions above, nothing in these Terms purports to waive or limit:
- (a) EU consumers — Brussels I Recast: Rights under EU Regulation 1215/2012 that entitle EU-resident consumers to bring proceedings in the courts of their member state of domicile, and the protections of mandatory consumer-law provisions of the member state in which they habitually reside, remain unaffected.
- (b) US state UDAP statutes: Protections afforded by any state's Unfair, Deceptive, or Abusive Acts or Practices (UDAP) statute — including the California Consumer Legal Remedies Act (Cal. Civ. Code §§ 1750 et seq.), the New York Consumer Protection Act, and equivalent statutes in other states — that cannot be waived or restricted by private agreement under the law of the state where the consumer resides.
SEVERABILITY AND WAIVER
If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision in any future instance.

19. EU PLATFORM-TO-BUSINESS DISCLOSURES
This section applies to business users — sellers who use FindMeComics in the course of a trade, business, craft, or profession and who are established or resident in the European Union — as required by EU Regulation 2019/1150 (Platform-to-Business Regulation, “P2B Reg.”).
RANKING PARAMETERS (Art. 5 P2B Reg.)
Search results and browse listings on FindMeComics are ordered by the following main parameters, listed in approximate order of weight:
- Paid promotion tier (highest weight) — sellers may optionally pay to have their listing appear in a clearly labelled Sponsored section above organic results. Sponsored placements are visually separated from, and do not affect, the organic ranking of any listing in the main grid.
- Relevance to search query — text match against title, issue number, publisher, and key-issue notes.
- Listing recency — newer listings rank higher within a relevance tier, on the basis that fresh inventory is more likely to be available.
- Price — when a buyer applies a price-sort filter, listings are ordered low-to-high or high-to-low accordingly; this overrides recency.
- Condition grade — when a buyer applies a grade filter, only matching grades are returned.
- Seller rating — among otherwise equal results, sellers with higher ratings may rank marginally higher.
Every paid placement is clearly labelled “Sponsored” in the interface. We do not give preferential treatment to our own goods or services because we do not sell items ourselves.
ACCOUNT RESTRICTION AND TERMINATION (Art. 4 P2B Reg.)
Where we decide to restrict, suspend, or terminate a business user's account, we will — except where immediate action is required to prevent serious harm, fraud, or legal violation — provide at least 30 days' advance notice by email, together with a statement of reasons for the decision. Where immediate action is taken, we will notify the business user of the reasons without undue delay unless prohibited by law.
Business users may challenge an account restriction, suspension, or termination through the internal complaint-handling process below or via mediation.
INTERNAL COMPLAINT HANDLING (Art. 11 P2B Reg.)
Business users may submit complaints about any of the following to legal@findmecomics.com:
- Alleged non-compliance by FindMeComics with obligations under the P2B Regulation that directly affect the complainant.
- Technological issues that directly and specifically affect the business user.
- Measures taken by FindMeComics that directly and specifically affect the business user.
We will acknowledge complaints within 5 business days and aim to resolve them within 30 days. We will communicate our assessment and any proposed resolution in writing. This complaint-handling system is free of charge.
MEDIATION (Art. 12 P2B Reg.)
If a complaint cannot be resolved through the internal process above, business users may request mediation. FindMeComics is willing to engage in good faith with mediators from either of the following organisations:
- Centre for Effective Dispute Resolution (CEDR) — cedr.com
- International Chamber of Commerce (ICC) International Centre for ADR — iccwbo.org/dispute-resolution
Each party bears its own share of the mediator's fees unless agreed otherwise. Participation in mediation does not waive any party's rights. EU consumers (non-business buyers) may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
ACCESS TO DATA (Art. 7 P2B Reg.)
Sellers can access the following data generated through their use of the platform, either directly in their account dashboard or on request:
- Their own listings (status, price, condition, creation date).
- Their own order history (buyer, amount, status, shipping).
- Their own seller reviews and ratings.
- Their full account data export via Dashboard → Settings → Download my data (GDPR Art. 20 / CCPA § 1798.110).
FindMeComics does not share individual seller transaction data with third parties except as described in the Privacy Policy. Aggregated, anonymised marketplace data (e.g., average sale prices) may be published without identifying individual sellers.
21. CALIFORNIA MARKETPLACE SELLER PROTECTIONS (AB 1790 / AB 2511)
This section applies to sellers who use FindMeComics in connection with a commercial purpose and who are California residents or whose principal place of business is in California, as required by California AB 1790 and AB 2511.
RANKING AND SEARCH FACTORS
See Section 19 (EU Platform-to-Business Disclosures) for a full description of the ranking parameters applied to marketplace search results. The same ranking methodology applies to all sellers regardless of jurisdiction.
MATERIAL CHANGES — ADVANCE NOTICE
We will give at least 30 days' advance notice by email before any material change to these Terms, the fee structure, or any condition of access or participation that is adverse to sellers. For changes required by law or necessary to prevent serious harm or fraud, notice will be given as promptly as practicable.
ACCOUNT RESTRICTION, SUSPENSION, AND TERMINATION
Before restricting, suspending, or terminating a seller account for a suspected policy violation, FindMeComics will:
- Notice: Send written notice to the seller's registered email describing the alleged violation and the proposed action, at least 30 days before the restriction takes effect, except where immediate action is required to prevent fraud, illegal activity, or serious harm to users or the platform.
- Cure period: Allow the seller 30 days to cure the identified violation where cure is possible. If the seller cures the violation within the cure period, no restriction will be imposed.
- Appeal: Provide the seller an opportunity to appeal the decision by emailing legal@findmecomics.com within 30 days of the notice. Appeals are reviewed by an administrator who was not involved in the original decision. FindMeComics will respond within 30 days of receiving a complete appeal.
The foregoing procedure does not apply to immediate account terminations for fraud, identity theft, illegal activity, or a serious and ongoing threat to the safety of users. In those cases, FindMeComics will provide notice and a statement of reasons without undue delay after the action is taken.
PROHIBITED DISCRIMINATION
FindMeComics will not restrict, suspend, terminate, or otherwise penalise a seller for exercising any right provided under California law, including the right to seek legal remedies or report violations to a government agency.
